1. Introduction

Welcome to Tara. These Terms & Conditions ("Terms") are a binding legal agreement between you ("you," "your") and Noviq LLC ("Noviq," "we," "our," "us") governing your access to and use of the Tara Wellness mobile application (the "App"), the website at tarawellness.org (the "Site"), and any related content, features, and services (together, the "Services").

By creating an account, downloading or using the App, or otherwise accessing the Services, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Services.

These Terms are governed by the laws of the state in which Noviq LLC is organized, without regard to its conflict-of-laws rules, except where applicable consumer-protection law provides otherwise.

2. The Service

Tara offers Vedic astrology guidance and wellness content — including birth-chart calculations, daily and long-term guidance, Panchāṅga and timing information, reflective practices, and personalized readings — computed from the birth information you provide.

Please read this carefully. The Services are provided for personal reflection, cultural, and entertainment purposes only. Tara does not provide medical, psychological, mental-health, financial, investment, legal, or other professional advice, and is not a substitute for consultation with a qualified professional. Astrological interpretations are interpretive, not predictive. Never disregard, delay, or make important medical, financial, legal, or life decisions in reliance on the Services. If you are experiencing a medical or mental-health emergency, contact your local emergency services or a qualified professional immediately.

3. Eligibility & User Obligations

Eligibility. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using Tara you represent that you meet this requirement.

Your account. You are responsible for the accuracy of the information you provide and for maintaining the security of your account and device. You agree to notify us promptly of any unauthorized use.

Acceptable use. You agree not to:

• use the Services for any unlawful, harmful, harassing, abusive, or fraudulent purpose;
• send spam or attempt to gain unauthorized access to the Services, other accounts, or our systems;
• reverse engineer, decompile, disassemble, scrape, or otherwise attempt to extract the source code, data, or underlying models of the Services, except to the extent this restriction is prohibited by law;
• interfere with, disrupt, or place undue load on the Services or their infrastructure; or
• resell, sublicense, or commercially exploit the Services or their content without our prior written permission.

4. Intellectual Property

The Services and all of their contents — including software, astrological calculation logic and interpretations, text, designs, graphics, the Tara name and logo, and other materials (excluding content you submit) — are owned by Noviq LLC or its licensors and are protected by intellectual-property and other laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-commercial, revocable license to access and use the Services for their intended purpose. You may not copy, redistribute, publish, or create derivative works from our content without our prior written permission.

Your content. If the Services let you submit content (for example, journal entries, questions, or reflections), you retain ownership of it. You grant Noviq a worldwide, royalty-free license to host, store, process, and display that content solely to provide and improve the Services to you, consistent with our Privacy Policy. You are responsible for the content you submit and represent that you have the right to submit it.

5. Disclaimers

• Vedic astrology is interpretive and cultural; it is not scientific, predictive, or guaranteed. Different traditions and practitioners may reach different conclusions.
• We do not warrant that the Services, calculations, or interpretations will be accurate, complete, reliable, uninterrupted, error-free, or suited to any particular purpose or outcome.
• THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, to the fullest extent permitted by law.
• You use the Services at your own discretion and risk.

6. Limitation of Liability

To the fullest extent permitted by law:

• Noviq LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Services or your reliance on their content.
• Noviq is not responsible for third-party services you interact with through the Services, including app stores, payment processors, and subscription managers (for example, Apple and RevenueCat), or for third-party links or content.
• Our total aggregate liability for any claim arising out of or relating to the Services is limited to the greater of (a) the total amount you paid us for the Services in the twelve (12) months preceding the claim, or (b) US$0 where the Services were provided free of charge.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case, our liability is limited to the greatest extent permitted by law.

7. Privacy

Your privacy matters to us. Our handling of your information — including the birth details and any content you provide — is described in our Privacy Policy. By using the Services, you consent to the data practices described there.

8. Payments, Subscriptions & Refunds

Tara may offer auto-renewing subscriptions (e.g., monthly or yearly Premium) and one-time purchases (e.g., report unlocks such as Year Ahead, Soul Blueprint, and Personal Remedies).

• Purchases and billing are processed through the Apple App Store and managed via RevenueCat. The applicable app-store terms also govern your purchase.
• Auto-renewal. Subscriptions renew automatically at the then-current price until cancelled. You can manage or cancel a subscription anytime in your Apple ID Settings → Subscriptions; cancellation takes effect at the end of the current billing period.
• Refunds. Refunds for App Store purchases are handled by Apple under the App Store Terms of Service — please contact Apple Support to request one. Except where required by law, digital content and reports that have been delivered or unlocked are non-refundable.
• Price changes to subscriptions will be communicated in accordance with app-store rules and will not take effect until your next renewal.

9. Termination

• By you. You may stop using the Services and cancel any subscription at any time (see Section 8).
• By us. We may suspend or terminate your access to the Services, with or without notice, if you violate these Terms or if we reasonably believe it is necessary to protect the Services, other users, or Noviq.
• Effect of termination. Upon termination, your license to use the Services ends. Sections that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Dispute Resolution) will survive. Handling and deletion of your data on termination is described in our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected here with a new "Last Updated" date and, where appropriate, noted in the App. Your continued use of the Services after an update constitutes acceptance of the revised Terms. If you do not agree to a change, stop using the Services.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in the state in which Noviq LLC is organized, and you and Noviq consent to the personal jurisdiction of those courts. Except where prohibited by law, in any action to enforce these Terms the prevailing party may be entitled to recover its reasonable attorneys' fees and costs.

12. General

These Terms are the entire agreement between you and Noviq regarding the Services and supersede prior agreements on that subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
